TERMS OF USE

Acceptance of Terms
By accessing or using the TAG AI platform at taghq.ai, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the platform. These Terms apply to all users including candidates, contractors, client organizations, and website visitors.
Platform Description
TAG AI is an AI-powered Talent Cloud platform that connects pre-assessed Cloud and AI engineering candidates with client organizations seeking contract and permanent talent. Our platform provides:
- • AI-powered candidate assessment and profile generation
- • Semantic talent matching and search
- • WhatsApp and email-based candidate engagement
- • Anonymized candidate presentation to client organizations
- • Contract placement coordination and onboarding support
We act as an intermediary between candidates and clients. We are not an employer of candidates unless explicitly agreed in a separate written agreement
No Guarantee of Employment or Placement
Use of the TAG AI platform does not guarantee any of the following:
- • Placement in a contract or permanent role
- • Scheduling of client interviews or introductions
- • A specific number of opportunities being presented to you
- • That any posted or described roles will result in active engagements
Some roles described on our platform may represent anticipated future demand. We make reasonable efforts to ensure accuracy but cannot guarantee the availability or terms of any specific opportunity.
Candidate Responsibilities
As a candidate or contractor using the TAG AI platform, you agree to:
- • Provide accurate, complete, and up-to-date information in your profile and during assessments
- • Not misrepresent your skills, experience, certifications, or employment history
- • Respond honestly to all AI-generated and human interview questions
- • Update your availability status promptly when your situation changes
- • Use the platform only for lawful purposes related to your professional career
- • Not share your account credentials with any other person
- • Not attempt to reverse engineer, scrape, or extract data from the platform
- • Comply with all applicable laws relating to your work authorization and tax obligations
Client Organization Responsibilities
As a client organization using the TAG AI platform, you agree to:
- • Ensure all role descriptions and hiring requirements are accurate and lawful.
- • Make all hiring decisions in compliance with applicable employment law including human rights legislation
- • Use candidate profile information only for the evaluation and potential hiring of that specific candidate
- • Not share candidate profile information with unauthorized third parties
- • Not circumvent the TAG AI platform to engage candidates directly in violation of your client agreement
- • Pay all fees agreed in your service agreement in a timely manner
- • Comply with non-circumvention provisions as set out in your signed Master Service Agreement
AI Disclaimer
Our platform uses artificial intelligence for candidate assessment, profile analysis, and talent matching. You acknowledge and agree to the following:
- • AI outputs are assistive tools — they are not final decisions. All AI-generated scores and assessments are subject to human review.
- • AI may occasionally produce inaccurate, incomplete, or unexpected outputs. We take reasonable steps to validate AI outputs but cannot guarantee perfection.
- • TAG AI team members review all candidate profiles before presenting them to clients. No automated decision results in a placement without human involvement
- • You have the right to request human review of any AI assessment decision that materially affects you.
- • We do not use AI to make decisions based on race, gender, age, religion, disability, or other protected characteristics.
Interview Participation
By participating in a TAG AI AI-powered interview or assessment, you acknowledge:
- • Your interview session may be recorded (audio and/or video) and transcribed
- • AI analysis will be applied to your responses to generate assessment scores
- • Participation is voluntary — you may withdraw at any time before submission
- • Recordings are used only for evaluation purposes and platform improvement
- • Recordings are retained for 12 months and then securely deleted
- • You may request deletion of your specific recording at support@taghq.ai at any time
Communications
By registering on the TAG AI platform and providing your contact details, you may receive:
- • WhatsApp messages regarding contract opportunities matching your profile.
- • Email communications regarding your account, placements, and platform updates.
- • BSMS messages as a fallback channel where WhatsApp is unavailable.
You can opt out of non-essential communications at any time by replying STOP to any WhatsApp or SMS message, clicking unsubscribe in any email, or contacting support@taghq.ai. Essential service communications cannot be opted out of while you have an active placement.
Intellectual Property
All content, technology, branding, and intellectual property on the TAG AI platform — including but not limited to our AI assessment methodology, matching algorithms, platform software, design, and TAG AI brand elements — are owned by TAG AI or its licensors.
You may not copy, reproduce, reverse engineer, decompile, distribute, sell, or create derivative works from any part of our platform or technology without our express written permission. Candidate resumes and professional content uploaded to the platform remain the intellectual property of the candidate. By uploading content, you grant us a limited license to process and use it to provide our services.Third-Party Services
Our platform integrates with third-party services for cloud hosting, AI processing, WhatsApp and SMS messaging, email delivery, analytics, and payment processing. We are not responsible for the privacy practices, terms, or actions of these third-party services. We are not responsible for the content of external websites linked from our platform, the accuracy of information provided by employers or clients, or hiring decisions made by client organizations.
Limitation of Liability
To the maximum extent permitted by applicable law, TAG AI shall not be liable for:
- • Indirect, incidental, special, consequential, or punitive damages.
- • Loss of employment, income, contracts, or business opportunities arising from use or inability to use the platform.
- • Inaccuracies in AI-generated assessments or matching results.
- • Actions or omissions of client organizations in their hiring processes.
- • Misuse of candidate data by client organizations beyond the scope of our client agreement.
- • Third-party service failures including WhatsApp, email delivery, or cloud infrastructure outages.
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
Indemnification
You agree to indemnify, defend, and hold harmless TAG AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:
- • Your violation of these Terms of Use
- • Your misrepresentation of skills, experience, or professional qualifications
- • Your unlawful use of the platform or another user's data
- • Your violation of any applicable law or regulation
Termination and Suspension
We may suspend or terminate your access to the platform at any time, with or without notice, for:
- • Violation of these Terms of Use
- • Providing false or misleading information
- • Conduct that harms other users, clients, or the platform
- • Any activity that we reasonably believe is unlawful
Account deletion requests are subject to our data retention policy as described in the Privacy Policy. Some information may be retained for legal and compliance purposes even after account deletion.
Modifications to These Terms
We may update these Terms of Use at any time. We will notify you of material changes via WhatsApp or email and by updating the version number and effective date at the top of this document. Continued use of the platform after notification of changes constitutes your acceptance of the updated Terms.
